Terms of Service

Vingo is a flyer creation and discovery tool that allows sellers to list pre-owned items and buyers to find and contact them. Vingo operates without user accounts. Anyone can visit justvingo.com, create a flyer, and publish it to the public gallery. Your flyer history is stored locally on your device via browser storage—not on our servers and not linked to any identity.

BUSEIT INTERNET PRIVATE LIMITED operates Vingo as an intermediary platform. We are not a party to any transaction between buyers and sellers and do not own, inspect, or guarantee any listed item.

To use Vingo, you must:

• Be legally capable of entering into a binding contract under Indian law
• Not be barred from using the Platform under any applicable law

Since Vingo has no account system, we cannot verify your age or identity at the point of use. By submitting a flyer, you represent and warrant that you meet all of the above conditions.

A flyer is a public listing created by a seller. It contains product details—including product name, price, condition, photographs, contact number, and location. As described in our Privacy Policy, once published, a flyer is visible to anyone who visits the Vingo gallery, including unauthenticated visitors.

By creating and publishing a Flyer, you represent and warrant that:

• You are the lawful owner of the item or are authorised to sell it
• All information in the Flyer is accurate, complete, and not misleading
• The item is legal to sell under applicable Indian law
• The item does not infringe any third-party intellectual property rights
• You have the right to use and share all photographs and content included

Prohibited Listings: The following are strictly not permitted on Vingo:

• Counterfeit, fake, or replica products
• Stolen goods or items obtained through illegal means
• Items banned or restricted under Indian law (weapons, narcotics, hazardous materials)
• Sexually explicit or obscene material
• Items that infringe third-party trademarks, copyrights, or patents
• Financial instruments, currency, or gift cards
• Live animals or products from endangered species

Vingo reserves the right to remove any listing that violates these Terms without prior notice and without liability to the person who submitted it.

Your flyers is your personal Flyer history, stored locally on your device using browser storage. It is not uploaded to our servers, not linked to any account or identity, and is not accessible to any other user.

Since your flyers exists only on your device:

• Clearing your browser storage will permanently delete your local Gallery
• Your Gallery is not transferable between devices or browsers
• Vingo cannot recover your Gallery if it is cleared or lost

Generated flyers are separately stored on our servers so they can be shared via a link and displayed on the public gallery. You may request deletion of any server-stored Flyer by contacting us at support@justvingo.com.

Vingo is a discovery platform only. We do not facilitate payments, handle escrow, manage logistics, or take physical or constructive possession of any listed item. All transactions are conducted directly between buyers and sellers.

Vingo does not guarantee that a buyer will purchase a listed item, that a seller will complete a sale, or that any transaction will be successful. We strongly recommend that both parties exercise due diligence before completing any transaction.

As a buyer, you are responsible for:

• Verifying the condition, authenticity, and description of an item before purchase
• Agreeing on price, payment method, and delivery terms directly with the seller
• Conducting in-person handovers or using trusted payment and logistics methods

Vingo is not responsible for resolving disputes between buyers and sellers. We may, at our sole discretion, assist in providing information for dispute resolution but are under no obligation to do so.

As described in our Privacy Policy, Vingo uses third-party services including AI processing tools (such as Google Gemini and OpenAI) to help generate Flyers, analytics providers, cloud hosting, and error monitoring services. We share only the minimum data required with these providers and do not authorize them to use your data for their own purposes.

Vingo's IP: All trademarks, logos, software, design elements, and content created by BUSEIT INTERNET PRIVATE LIMITED — including the Vingo name and brand — are our exclusive property. You may not use, reproduce, or distribute any of these without prior written consent.

Your Content: You retain ownership of all content you submit, including Flyer photographs, descriptions, and Personal Stories. By submitting a Flyer, you grant BUSEIT INTERNET PRIVATE LIMITED a non-exclusive, royalty-free, worldwide licence to display and distribute that content solely for the purpose of operating and promoting the Vingo Platform.

You agree not to:

• Post false, misleading, or fraudulent listings or information
• Impersonate any person or entity
• Use the Platform for any unlawful purpose
• Scrape, crawl, or extract data from the Platform without prior written permission
• Interfere with or disrupt the Platform's infrastructure or security
• Use automated tools, bots, or scripts to interact with the Platform
• Harass, threaten, or abuse other users
• Attempt to gain unauthorised access to any system or data
• Circumvent any content-filtering or safety mechanism on the Platform

Violation of any of the above may result in removal of your Flyers and may be reported to law enforcement authorities where applicable.

We aim to keep Vingo available at all times but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice.

THE VINGO PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

BUSEIT INTERNET PRIVATE LIMITED does not warrant:

• The accuracy, completeness, or reliability of any Flyer content posted by users
• The quality, safety, or legality of any item listed on the Platform
• That the Platform will be error-free or uninterrupted

To the fullest extent permitted by applicable law, BUSEIT INTERNET PRIVATE LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Any transaction conducted between buyers and sellers via the Platform
• Any inaccurate, misleading, or fraudulent listing
• Loss of locally stored Flyer history due to browser storage being cleared
• Loss of data, revenue, profits, or goodwill
• Any interruption or unavailability of the Platform

Our total aggregate liability to you for any claim arising from your use of Vingo shall not exceed INR 1,000 (Indian Rupees One Thousand Only).

You agree to indemnify, defend, and hold harmless BUSEIT INTERNET PRIVATE LIMITED, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, any Flyer or content you submit, your violation of these Terms, or your violation of any third-party rights.

As described in our Privacy Policy, you can at any time:

• Delete Flyers from your local Gallery via the History page
• Withdraw analytics consent by clearing your browser storage for justvingo.com
• Request deletion of server-stored Flyer data by contacting us at support@justvingo.com

We will respond to all deletion requests within 30 days.

In accordance with Indian law, any grievances relating to these Terms or our Privacy Policy may be directed to our Grievance Officer:

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, Karnataka, India.

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this document. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BUSEIT INTERNET PRIVATE LIMITED with respect to your use of Vingo and supersede all prior agreements and understandings.
